Introduction
1.1Welcome to www.educantic.com ("Website") and the Educantic school ERP application, including any instance made available on an institute's own custom domain ("Application"), together the "Platform". Educantic is a school and institute management system covering admissions, attendance, fee management, gradebooks, timetables, communication, and an AI assistant ("Educantic AI"), owned and operated by Educantic and its affiliates ("Company", "we", "us", "our").
1.2These Terms of Service ("Terms"), together with our Privacy Policy and any order form, subscription agreement, or institute-specific agreement (collectively, the "User Agreements"), govern your access to and use of the Platform. "You" and "User" mean any person who accesses or uses the Platform, including administrators, teachers, parents, and students.
1.3If you are a resident of India and under the age of 18 — or in any other country, below the age at which you may independently agree to online terms — you may only use the Platform through an account created and supervised by a parent or legal guardian, or by your institute, in accordance with Section 4.
1.4If you are using the Platform on behalf of a school, coaching institute, college, or university as an administrator ("Admin User"), you confirm that you have the authority to bind that institute to these Terms.
1.5This is an electronic record under the Information Technology Act, 2000 and rules made thereunder, and does not require any physical or digital signature.
1.6By accessing or using the Platform, you agree to these Terms, our Privacy Policy, and any applicable order or subscription agreement. If you do not agree, please do not use the Platform — you may write to
support@educantic.com and we will try to help.
1.7Where your institute has a subscription agreement or order form with the Company, that document governs the Subscription Period, seat count, and modules licensed to your institute. These Terms and the Privacy Policy are co-terminous: expiry or termination of one ends the other, and access for accounts under an institute ends when that institute's Subscription Period ends.
§02
System Requirements
2.1Using Educantic requires a compatible device, a modern browser or the Educantic mobile app, and internet access. Educantic's offline-capable modules allow limited use during connectivity gaps, but data will not sync until you are back online. Keeping your device, browser, and the app updated is your responsibility.
§03
License to Use Educantic
3.1We provide the Platform and standard updates made generally available to subscribed institutes. We may modify, add, or discontinue individual features at our discretion, and will make reasonable efforts to notify institutes of material changes.
3.2Subject to these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable right to access and use the Platform solely for your institute's educational and administrative purposes.
3.3Where your institute uses a custom domain to access Educantic, that domain remains subject to these Terms in the same way as www.educantic.com.
3.4Access within an institute is role-based. What a User can view or do — as Admin, Teacher, Parent, or Student — is set by the Admin User, and any data generated is scoped to that role.
§04
Accounts & Roles
4.1Accounts are typically created by your institute's Admin User, using accurate and current information. Inaccurate or outdated information may lead to suspension of the account.
4.2Where a User is a minor, the parent/guardian or the institute (acting in loco parentis for school-related use) is responsible for that account, and use is understood to be supervised accordingly.
4.3Accounts are verified via email or mobile OTP where enabled. You agree to keep your registered details accurate and current.
4.4You are responsible for all activity under your login credentials and must notify us or your Admin User immediately of any suspected unauthorized access.
4.5Your institute's Admin User may create, suspend, or remove your access at their discretion, in line with their own internal policies.
4.6We reserve the right to suspend or terminate any account used in violation of these Terms, at our sole discretion.
§05
Communications
5.1By using the Platform you agree that we communicate with you electronically — in-app notifications, SMS, WhatsApp, and email — for service updates, attendance/fee alerts, and product announcements. You may opt out of non-essential communications via the unsubscribe link or by emailing
support@educantic.com; transactional and safety-related notices (e.g. fee due dates, attendance alerts) cannot be opted out of while your account remains active.
5.2We may contact prospective institutes who request a demo, trial, or pricing information through phone, WhatsApp, SMS, or email regarding the Platform.
§06
Plans, Fees & Billing
6.1Educantic is offered on subscription plans (currently Silver, Gold, Premium, and Enterprise) that differ by modules, seats, and support level, as described on the Platform or in your institute's order form.
6.2We may introduce new plans, retire old ones, or change pricing. Changes will not apply mid-term to an active Subscription Period unless agreed otherwise in your order form; we will make reasonable efforts to notify you ahead of renewal.
6.3If a pricing or listing error occurs on the Platform, we may correct it or cancel the affected order and refund any amount collected, within 90 business days of discovering the error.
Educantic does not provide fee-financing, lending, or third-party loan facilitation to parents or students. Fee collection features (online payment, eNACH, receipts) are limited to processing amounts your institute itself sets and collects.

Fair Use Policy
7.1Each subscription includes fair-use limits. Usage beyond these thresholds may require an upgraded plan or additional charges, communicated in advance.

§08
Institute Data & Educantic AI Output
Data you put in. "Content" means anything a User uploads or enters into Educantic — student records, attendance marks, fee entries, documents, messages, and prompts typed into Educantic AI.
8.1You (or your institute) retain ownership of Content you submit. You are responsible for its accuracy and for having the right to enter it — particularly student and parent personal data, which must be handled in line with your institute's own data-protection obligations.
8.2We do not claim ownership of your institute's Content. We use Content only to provide the Service to your institute, and, in de-identified or aggregated form, to maintain and improve the Platform, unless your institute agreement says otherwise.
8.3We may disclose Content where required by law, court order, or a valid governmental request.
Output. "Output" means anything generated by the Platform in response to your data or prompts — report cards, analytics, timetables, or answers from Educantic AI.
8.4Educantic AI is based on evolving technology and will not always be accurate or complete. Output should always be reviewed by a teacher or administrator before being relied on for academic, administrative, or communication purposes, and should not replace professional educational judgment.
8.5You may use Output generated for your institute for your institute's own purposes. You may not use Output from Educantic AI to build, train, or benchmark a competing AI model or education product.
Educantic AI results are a starting point, not a final answer — a human should always check grades, report content, and parent-facing messages before they go out.
§09
Acceptable Use
You agree not to use the Platform to post, upload, or transmit Content that:
- Belongs to someone else and that you have no right to use;
- Is obscene, harassing, discriminatory, or harmful to a minor in any way;
- Infringes a patent, trademark, copyright, or other proprietary right;
- Is knowingly false, misleading, or impersonates another person;
- Contains malware, viruses, or code designed to disrupt the Platform;
- Is unlawful, defamatory, or incites violence or hatred against any group.
You also agree not to:
- Overload, disable, or attempt to disrupt the Platform, including denial-of-service activity;
- Scrape, crawl, or use automated tools to extract data beyond your authorized access;
- Attempt to bypass role-based access controls or access another institute's data;
- Reverse-engineer, decompile, or disassemble the Application;
- Misrepresent Educantic AI output as independent human-authored work where that would mislead a reader;
- Use Educantic AI output to train a competing generative AI or learning model.
§10
Payments
10.1Where the Platform enables online fee collection, payments are processed through third-party payment service providers ("PSPs"). You must never share UPI PINs, OTPs, or card credentials with anyone claiming to represent Educantic — we never ask for these over call, message, or email.
10.2We are not responsible for transaction declines, bank-side authorization failures, or amounts sent to an incorrect account or VPA due to User error.
10.3We are not responsible for any payment made to a third party falsely claiming to represent Educantic.
§11
Refunds & Cancellation
11.1Subscription fees paid by institutes are governed by the refund terms in the applicable order form or subscription agreement. Absent a specific term there, subscription fees are non-refundable once the Subscription Period has begun.
11.2School fees collected on behalf of an institute through the Platform's payment features are refundable only per that institute's own refund policy — Educantic is a payment facilitator in that flow, not the fee recipient.
§12
Analytics & Improvement
12.1We analyze usage data — which features are used, how often, and where errors occur — to maintain and improve the Platform. This may include working with trusted third-party analytics providers under confidentiality obligations.
12.2Analytics are used to improve reliability, prioritize features, and provide support, not to build individual profiles of students for purposes unrelated to the Service.
§13
Intellectual Property
13.1The Platform itself — its code, design, "Educantic" names and logos, interfaces, and Educantic AI models — is owned by the Company and protected under applicable copyright and trademark law. This does not extend to your institute's own Content.
13.2Except as expressly permitted, no part of the Platform may be copied, republished, or redistributed for any commercial purpose without our prior written consent.
§14
Copyright Policy
14.1We respect the intellectual property rights of others and expect Users to do the same. Accounts found to be infringing third-party copyright may be suspended or terminated.
§15
Feedback
15.1If you send us feedback, bug reports, or feature suggestions, we may use them to improve Educantic without any obligation to compensate you, and without your feedback being treated as confidential.
§16
Third-Party Links
16.1The Platform, including Educantic AI, may reference or link to third-party services or public resources not controlled by us. We are not responsible for their content, availability, or practices, and recommend reviewing their own terms before use.
§17
Disclaimer
The Platform, including Educantic AI output, is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or that Educantic AI output will always be accurate — it should be reviewed before being relied upon. To the extent permitted by law, all implied warranties of merchantability and fitness for a particular purpose are disclaimed.
§18
Limitation of Liability
Except as prohibited by law, our total liability arising from your use of the Platform is limited to the subscription fees paid by your institute in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including loss of data or business interruption, arising from use of or inability to use the Platform.
§19
Termination
19.1We may suspend or terminate an account or an institute's access for breach of these Terms, at our discretion, with notice where reasonably possible.
19.2An institute may discontinue use at any time, subject to any minimum-term or notice provisions in its subscription agreement.
19.3Provisions that by their nature should survive termination — ownership, disclaimers, indemnity, and liability limits — continue to apply after termination.
§20
Governing Law
20.1These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at [Patna, Bihar]
§21
Force Majeure
21.1We are not liable for delays or failures caused by events beyond our reasonable control, including natural disaster, war, civil disturbance, government action, internet or power outages, or public health emergencies.
§22
Changes to the Service
22.1We may add, modify, or withdraw features of the Platform at our discretion. We will make reasonable efforts to notify institutes of changes that materially affect the Service they subscribe to.
§23
Amendments to these Terms
23.1We may revise these Terms by posting updated Terms on this page. Changes take effect 30 days after posting or direct notice, whichever is earlier.
23.2Continued use of the Platform after that date means you accept the revised Terms. If you do not agree, you should stop using the Platform.
§24
Waiver & Severability
24.1Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
24.2If any provision is found unenforceable, the remaining provisions continue in full effect.
§25
Assignment
25.1We may assign or transfer our rights and obligations under these Terms without your consent, including in connection with a merger, acquisition, or restructuring. You may not assign your rights under these Terms without our written consent.

Acknowledgement
26.1By using the Platform, you confirm that you have read and agree to be bound by these Terms of Service.
